Cold Laser Protocols LLC, d/b/a ColdLaserProtocols.com (“the Site”) collects, uses and is responsible for certain personal information about you. When we do so we may be regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we may be responsible as controller of that personal information for the purposes of those laws.

In the course of facilitating access to Cold Laser Protocols and/or post-accident professionals such as lawyers and doctors, we collect the following personal information when you provide it to us:

  • Information you have provided us with, including but not limited to, for example: dates, location, and other details submitted by you regarding your accident; personal names, physical addresses, email addresses, phone numbers, and other contact information submitted by you; your self-reported interest in meeting with an attorney or doctor regarding your accident; any other information submitted by you using forms on our Site;
  • Information automatically collected about you may include information that is automatically stored by cookies and other sessions tools, including but not limited to, for example: your IP address, your browsing history on the Site, you shopping history (if any), etc. When you use our services or look at the contents of the Site, your activities may be logged.

We use the information obtained as described above to:

  • facilitate your access to Cold Laser Protocols and/or to provide you such records in compliance with the Drivers Privacy Protection Act (DPPA) (18 U.S.C. § 2721, et seq.) and applicable law;
  • facilitate access to and/or refer you to medical and legal professionals within the applicable jurisdiction who may be available to assist regarding claims attendant to your accident;
  • subscribe you to various marketing, advertising, and solicitation lists, with your notice and consent through this Privacy Policy and the Terms & Conditions available at https://ColdLaserProtocols.com/terms-conditions, to participating medical and legal professionals who service accident victims;
  • to enhance your customer experience and/or provide you with personalized offers from us and selected partners;
  • to conduct questionnaires concerning customer and user satisfaction;
  • to administer and analyze our client base, including browsing behavior and history, to improve the quality, variety, and availability of products and services offered or provided;
  • to offer your products and/or services that are similar or same to those which are indicated by your history/browsing behavior;
  • to send you newsletters and campaign offers from us and selected partners;
  • for other purposes for which we have obtained your consent.
  1. Who We Share Your Personal Information With

We routinely share the above-described personal data with third-party medical professionals (including doctors and chiropractors) and legal professionals (including lawyers and their staff) (collectively, our “Referral Partners”) for the purposes described above. This list of Referral Partners changes from time to time and is tailored to licensed professionals in the applicable jurisdiction based on your self-reported location and other information. This data sharing enables Referral Partners to contact you directly, with your consent, with information and offers to provide services related to your vehicle accident and any attendant claims. Some or all of those third-party recipients may be based outside the European Economic Area.

We will share personal information with law enforcement or other authorities if required by applicable law.

We will not share your personal information with any other third party without notice and consent provided throughout this Privacy Policy and the Terms & Conditions available at https://ColdLaserProtocols.com/terms-conditions.

  1. Whether Information Has to Be Provided by You and Why

The provision of the personal information described above is required from you to enable us to facilitate access to Cold Laser Protocols and professionals and otherwise achieve the purposes set forth 2.3 and 2.4 above. We will inform you at the point of collecting information from you, whether you are required to provide the information to us. Failing to provide accurate and/or complete information may affect our ability to provide the services and achieve the purposes set forth above. At no time do we ever require the collection or disclosure of information protected by attorney-client privilege, doctor-patient privilege, or any other privilege recognized by statute or common law, nor do we ever require collection of disclosure of confidential health information protected by the Health Insurance Portability and Accountability Act of 1996  (“HIPAA”) or any other law addressing confidential health information.

By submitting and/or obtaining information through the Site, you are agreeing that you are agreeing that you have a right to submit and/or obtain that information for purposes consistent with applicable law, including but not limited to the Drivers Privacy Protection Act (DPPA) (18 U.S.C. § 2721, et seq.). Submitting and/or obtaining information for an unapproved and/or unlawful purpose may expose you to criminal or civil liability for computer fraud laws governing the use and disclosure of personal and/or public records.

We do not intend to collect or knowingly collect information from children. By submitting information and/or continuing to use the Site, you are representing to us that you are not a minor child or collecting information on the behalf of a minor child.

  1. How Long Your Personal Information Will Be Kept

We will hold the personal information described above indefinitely for any and all above-described purposes for as long as is determined to be necessary, in our discretion, to achieve the purposes and provide the services described above.

  1. Reasons We Can Collect and Use Your Personal Information

We rely on your consent, compliance with our legal and contractual obligations to Referral Partners and you, and/or our legitimate interests as the lawful bases on which we collect and use the personal information described above. Our legitimate interests include the purposes set forth in 2.3 and 2.4 above, including but not limited to generally facilitating your access to accident records, access to medical and legal professionals concerning your accident claims, and marketing, solicitation, and other offers regarding services from professionals who market to accident victims. As long as you have not informed us otherwise, we consider offering you products and/or services that are similar or same to those relating to your history, browsing behavior, and other information gathered as described above to be our legitimate interest.

  1. Consequences of Our Use of Your Personal Information

In addition to and consistent with the purposes set forth throughout Section 2, above, your personal data may be used in the following manner.

3.1 How We Secure Your Data

We do our best to keep your personal data safe.  We use safe protocols for communication and transferring data (such as HTTPS). We use anonymizing and pseudonymizing where suitable. We monitor our systems for possible vulnerabilities and attacks using the Wordfence plugin.

Even though we try our best we, cannot guarantee the security of information. However, we promise to notify suitable authorities of data breaches. We will also notify you if there is a threat to your rights or interests. We will do everything we reasonably can to prevent security breaches and to assist authorities should any breaches occur.

If you have an account with us, note that you have to keep your username and password secret.

We use cookies and/or similar technologies to analyze customer behavour, administer the website, track users’ movements, and to collect information about users. This is done in order to personalize and enhance your experience with us.

  1. Transfer of Your Information Out of the EEA

Cold Laser Protocols LLC and the Site are based in the United States of America, and the Site provides referral and other information to Referral Partners comprising medical and legal professionals licensed in various jurisdictions throughout the United States as described throughout the Privacy Policy. We may transfer your personal information to individuals and organizations with the United States as well as other countries which are located outside the European Economic Area (EEA)

Such countries do not have the same data protection laws as the United Kingdom and EEA. Whilst the European Commission has not given a formal decision that such countries provide an adequate level of data protection similar to those which apply in the United Kingdom and EEA, any transfer of your personal information will be subject to the relevant provisions of the General Data Protection Regulation that are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your personal information.
